Slight modification to uploader agreement
We are modifying our standard uploader agreement. Generally we will give 30 days' advance notice on such modifications, but in this case we're only going to be limiting Kongregate's rights, so I think we can start effective immediately without anyone minding. The old version of Section 2 read like this:
2. License. Developer hereby grants to Kongregate a worldwide, non-exclusive, sublicensable right and license to (i) use, reproduce, distribute, display, publicly perform, deliver, market, and promote, Developer Materials through the Kongregate Platform, and (ii) to develop, create, implement, and/or distribute modifications from Developer materials as necessary in order to incorporate Developer Materials in the Kongregate Platform consistently with Developer's warranties and the terms of this agreement.
The new version removes Section 2.ii (which gave us the right to modify the game as needed) and the word "sublicensable". This was older language and doesn't really apply to our game uploads any more, so there's no reason for us to reserve those rights. The new Section 2, effective immediately, reads:
2. License. Developer hereby grants to Kongregate a worldwide, non-exclusive right and license to use, reproduce, distribute, display, publicly perform, deliver, market, and promote, Developer Materials through the Kongregate Platform.
